These Terms form a binding agreement between Jam 7 Limited, referred to in these Terms as Jam 7, we, us or our, and you as an authorised user of AMP.
AMP is Jam 7's Agentic Marketing Platform®. It is a software service used by marketing teams to plan, generate, review and manage marketing work.
By creating an account, signing in or using AMP, you agree to comply with these Terms. If you do not agree to these Terms, you must not use AMP.
These Terms should be read with the AMP Privacy Notice, Cookie Notice, AI Processing Notice and any applicable customer agreement or data processing terms between Jam 7 and the organisation that authorises your access.

3. Eligibility
AMP is intended for authorised business users and is not directed at children.
If you access AMP on behalf of an organisation, you confirm that you are authorised by that organisation to do so.
You must not use AMP if you are subject to sanctions, if your use would breach applicable export control laws or if Jam 7 has previously suspended or removed your access.
AMP is a business-to-business service. It is not intended for consumer, child or household use.
4. Accounts and Security
Authentication is provided through Auth0 and supported identity providers. You may be required to verify your email address or complete additional security checks before accessing AMP.
You must provide accurate account information and keep it up to date.
You are responsible for maintaining the confidentiality of your credentials and for activity under your Account. You must not share your Account or credentials with any other person.
You must use multi-factor authentication where it is required or made available for your role. You must notify Jam 7 promptly at compliance@jam7.com if you suspect unauthorised access or compromise.
Jam 7 may suspend access immediately where it reasonably believes this is necessary to protect AMP, Jam 7, customers, users or third parties from security, legal or operational risk.
5. Customer Relationship
If your Account is associated with a customer organisation, that organisation may administer your access, manage your role, view limited usage information, export Customer Content and remove your access.
The relationship between you and that organisation is not controlled by Jam 7. You are responsible for complying with that organisation's policies and instructions when using AMP.
Jam 7 acts as controller for authorised user account and platform usage data.
Jam 7 acts as processor for Customer Content except where Jam 7 determines the purposes and means of processing under applicable law.
6. Fees and Paid Access
Where AMP is provided under a customer agreement, fees, payment terms, usage limits, support terms and subscription details are governed by that customer agreement.
Where Jam 7 makes any trial, pilot, beta or unpaid access available, Jam 7 may change, limit, suspend or withdraw that access at any time. Unpaid access is provided without any service level commitment unless Jam 7 agrees otherwise in writing.
Except where required by mandatory law or expressly agreed in writing, fees are non-refundable.
7. Acceptable Use
You must use AMP only for lawful business purposes and in accordance with these Terms, applicable laws and any customer organisation policies that apply to you.
You must not use AMP to create, store, transmit or facilitate unlawful, harmful, abusive, defamatory, fraudulent, deceptive, infringing, harassing, hateful, terrorist, extremist, sexually exploitative or otherwise prohibited content.
You must not use AMP to create malware, phishing material, cyber abuse material, instructions for weapons or content that supports criminal activity.
You must not submit special category data, criminal offence data, children's data, payment card data, secrets or unnecessary personal data unless your organisation has a lawful basis and Jam 7 has agreed the relevant processing where required.
You must not use AMP to send spam or unsolicited communications, or to breach privacy, intellectual property, consumer protection, advertising, competition, sanctions or export control laws.
8. High Risk Uses
AMP must not be used as the sole basis for decisions that have legal or similarly significant effects on individuals.
Prohibited high-risk uses include medical diagnosis or treatment, regulated legal advice, regulated financial advice, insurance underwriting, credit decisions, hiring decisions, employment management, housing decisions, education decisions, immigration decisions and decisions affecting safety of life or critical infrastructure.
AMP outputs are intended to support human workflows. They must be reviewed by an appropriately qualified person before use in any material business context.
9. System Abuse and Security Testing
You must not interfere with AMP security, rate limits, access controls or platform integrity.
You must not access, attempt to access, copy, export or modify any account, workspace, data or content that you are not authorised to access.
You must not conduct vulnerability scanning, penetration testing, denial of service activity, brute force activity, credential stuffing or automated scraping without Jam 7's prior written approval.
You must not deliberately submit prompts, files or instructions designed to bypass security controls, exfiltrate data, reveal system prompts, misroute requests or cause AMP to operate outside its intended scope.
Jam 7 may implement technical protections, usage monitoring, rate limits and abuse prevention measures reasonably necessary to protect AMP, users, customers and third parties.
10. AI Outputs
Outputs are generated by AI systems and may be inaccurate, incomplete, biased, outdated, fabricated or unsuitable for a particular purpose.
Outputs are provided as a productivity aid. They are not professional advice and must not be treated as legal, medical, financial, employment, regulatory or other professional advice.
You are responsible for reviewing, verifying and approving Outputs before relying on, publishing, distributing or acting on them.
Users are responsible for determining whether Outputs are suitable for publication, distribution, commercial use or legal compliance.
Jam 7 does not guarantee that Outputs are legally compliant, factually accurate, non-infringing or suitable for commercial publication.
Users remain responsible for ensuring that their use of Inputs and Outputs complies with applicable laws, regulations, advertising standards, intellectual property rights and industry requirements.
Generative AI systems may produce similar or identical Outputs for different users. Jam 7 does not guarantee that Outputs are unique, original, accurate or non-infringing.
11. Customer Content and Rights
As between Jam 7 and you or your customer organisation, Customer Content remains owned by you or the customer organisation, subject to any rights held by third parties.
You confirm that you have all rights, permissions, consents and lawful bases needed to submit Inputs to AMP and to allow Jam 7 to process them for the purposes of providing, maintaining, securing, supporting and lawfully operating AMP in accordance with applicable agreements and notices.
Jam 7 may host, store, transmit, process and display Inputs and Outputs as needed to provide AMP, maintain security, prevent abuse, comply with law and support the customer organisation.
Jam 7 does not use Customer Content to train externally shared or publicly available general-purpose AI models unless expressly agreed with the relevant customer.
Jam 7 does not claim ownership of Customer Content. Jam 7 retains all rights in AMP, its software, agents, workflows, prompts, configurations, infrastructure, designs, models, templates and underlying technology.
12. Intellectual Property
Jam 7 and its licensors own all rights in AMP and the Service. No rights are granted to you except the limited right to access and use AMP in accordance with these Terms and any applicable customer agreement.
You must not copy, modify, reverse engineer, decompile, disassemble, extract, reconstruct, benchmark for the purpose of developing a competing product or service, frame, mirror, resell or create a competing product from AMP, except to the extent mandatory law prevents this restriction.
If you provide feedback, suggestions or ideas, you grant Jam 7 a worldwide, royalty-free, perpetual and irrevocable right to use that feedback to improve AMP and other Jam 7 products or services without restriction or payment to you.
AMP, Agentic Marketing Platform® and related marks, names and logos are owned by Jam 7 or its licensors. You must not use them without prior written consent.
13. Privacy and Cookies
Jam 7's processing of personal data about authorised users is described in the AMP Privacy Notice.
Cookies and similar technologies are described in the Cookie Notice. AMP provides a cookie preferences panel where users can choose essential cookies only or accept optional analytics.
Where Customer Content contains personal data controlled by a customer organisation, Jam 7 processes that personal data under the applicable data processing terms with that organisation.
14. Confidentiality
You must keep confidential any non-public information about AMP, including security information, unpublished features, beta features, commercial terms, technical information, system behaviour and documentation marked or reasonably understood as confidential.
Confidential information includes system prompts, agent configurations, workflows, orchestration logic, unpublished features and non-public AI behaviours or outputs.
You may use confidential information only to use AMP in accordance with these Terms.
This obligation does not apply to information that is public through no fault of yours, already known to you without restriction, lawfully received from a third party or independently developed without using Jam 7 confidential information.
15. Beta and Preview Features
Jam 7 may make beta, preview, pilot or experimental features available. These features may be unstable, incomplete, changed or withdrawn at any time.
Beta and preview features are provided "as is" and without any service level commitment, support commitment or warranty to the maximum extent permitted by law.
16. Service Changes and Availability
Jam 7 will use reasonable efforts to make AMP available, but does not guarantee that AMP will be uninterrupted, error-free or available at all times.
Jam 7 may modify, suspend, limit, remove or discontinue any feature or part of AMP. Jam 7 may carry out scheduled or emergency maintenance and may impose usage controls or rate limits.
17. Suspension and Termination
Jam 7 may suspend or terminate your access if you breach these Terms, create a risk to AMP, Jam 7, a customer or another user, fail to pay applicable fees, become subject to sanctions, or if a customer organisation instructs Jam 7 to remove your access.
You may stop using AMP at any time. If your access is provided by a customer organisation, termination of your access may be managed by that organisation.
On termination, your right to access AMP ends. Jam 7 may retain, delete or anonymise data in accordance with applicable agreements, retention rules, legal obligations and the Privacy Notice.
18. Warranties and Disclaimers
AMP, Outputs, documentation and beta features are provided "as is" and "as available" to the maximum extent permitted by law.
Jam 7 does not warrant that AMP or any Output will be uninterrupted, error-free, secure, accurate, complete, non-infringing, fit for a particular purpose or compatible with any particular system or third-party service.
No advice or information from Jam 7 creates a warranty unless expressly agreed in writing by Jam 7.
19. Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot lawfully be limited or excluded.
Subject to the previous sentence, Jam 7 is not liable for loss of profit, revenue, business, goodwill, opportunity, data, content, software, use of AMP, reliance on Outputs, third-party services, indirect loss, consequential loss or losses arising from breach of these Terms.
Subject to the first sentence of this section, Jam 7's total aggregate liability arising out of or in connection with these Terms or AMP is limited to the greater of the fees paid to Jam 7 for your access in the 12 months before the event giving rise to liability or one thousand pounds sterling (£1,000).
Where access is provided as a trial, pilot, beta or unpaid service, Jam 7's total aggregate liability is limited to one thousand pounds sterling (£1,000), subject to liabilities that cannot lawfully be limited or excluded.
20. Indemnity
You will indemnify Jam 7 and its affiliates, officers, directors, employees, contractors and agents against claims, losses, liabilities, damages, fines, penalties, costs and expenses arising from your breach of these Terms, your unlawful use of AMP or your infringement of third-party rights through your Inputs or use of the Service.
21. Force Majeure
Jam 7 is not liable for delay or failure to perform caused by events beyond its reasonable control. This includes acts of God, war, terrorism, civil unrest, epidemic, pandemic, government action, sanctions, labour disputes, fire, flood, power failure, telecommunications failure, internet outages, third-party provider failures, denial of service attacks and similar events.
22. Changes to these Terms
Jam 7 may update these Terms from time to time. Where a change is material, Jam 7 will take reasonable steps to notify authorised users by email, in-product notice or publication of updated Terms.
Continued use of AMP after updated Terms take effect constitutes acceptance of the updated Terms. Jam 7 may require users to accept updated Terms before continuing to use AMP.
23. Notices and Contact
Notices to you may be given by email to the address associated with your Account, by in-product notice or by posting on AMP.
Legal, privacy, data rights, security and compliance enquiries to Jam 7 should be sent to compliance@jam7.com.
24. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales.
The courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, except that Jam 7 may seek injunctive relief or enforce intellectual property rights in any competent jurisdiction.
25. General
These Terms, together with the Privacy Notice, Cookie Notice, AI Processing Notice and any applicable customer agreement or data processing terms, form the relevant terms governing your use of AMP.
If any part of these Terms is invalid or unenforceable, the remaining parts remain in effect.
Failure by Jam 7 to enforce any right is not a waiver of that right.
You may not assign or transfer your rights under these Terms without Jam 7's prior written consent. Jam 7 may assign or transfer its rights and obligations in connection with a reorganisation, merger, acquisition, sale of assets or transfer to an affiliate.
A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999, except where these Terms expressly protect a customer organisation or Jam 7 affiliate.
